These Terms are governed by the laws of New South Wales, Australia.

1.2 Definitions

In these Terms:

  • "Napstar", "we", "our", or "us" means Pear Care Pty Ltd trading as Napstar.
  • "Website" means https://napstar.com.au.
  • "Products" means all goods sold via the Website.
  • "Customer", "you", or "your" means any purchaser or website user.
  • "Australian Consumer Law" or "ACL" means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

1.3 Eligibility

By using this Website, you represent that:

  • You are at least 18 years of age and possess the legal capacity to enter binding agreements.
  • All information supplied by you is accurate, current, and complete.

1.4 Product Information

Napstar endeavours to ensure all product descriptions, images, pricing, and specifications are accurate. However:

  • Colours and packaging details may vary slightly from screen displays.
  • Absorbency, fit, and general comfort metrics may vary from child to child.
  • We reserve the right to modify specifications without prior notice in our commitment to ongoing performance improvements.

1.5 Order Acceptance & Pricing Errors

All orders are subject to stock availability, payment approval, and security checks. In the rare event of a pricing or system error, Napstar reserves the right to cancel the order, refuse fulfilment, and issue a full refund of any monies paid, and is not obligated to honour transactional errors.

2. Privacy Policy

Napstar respects your privacy and is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth).

2.1 Information We Collect

To process orders, subscriptions, and handle customer service, we collect:

  • Contact details (names, phone numbers, email and shipping addresses).
  • Device information, IP addresses, browsing behaviour, and cookies via analytics.

2.2 Use of Information

Information collected is strictly utilized to process transactional order pipelines, communicate regarding sub-billing profiles, prevent merchant fraud, optimize user experiences, and coordinate marketing actions where prior customer consent is established.

3. Shipping & Delivery Policy

3.1 Delivery Timeframes

Estimated delivery windows are indicative guidelines. Napstar is not legally liable for delayed arrivals caused by third-party logistical providers, weather, seasonal volume spikes, or force majeure events.

3.2 Authority to Leave (ATL)

Where Authority to Leave is declared, Napstar is immediately exempt from liability concerning stolen packages, weather-soiling, tampering, or missing parcels post courier drop-off. Courier geolocation records and photos constitute final proof of successful delivery.

4. Returns & Refund Policy

4.1 Australian Consumer Law Compliance

Our returns policy strictly aligns with rights and guarantees outlined inside the Australian Consumer Law (ACL). Remedies will be immediately issued for verified product faults.

4.2 Hygiene Exclusions

Due to strict hygiene requirements, Napstar is unable to accept returns, change-of-mind refunds, or exchanges on opened packages of nappies, wet wipes, opened baby consumables, or items with broken commercial seal lines. Please verify nappy sizing parameters before breaking outer package wraps.

5. Product Safety & Usage Disclaimer

5.1 Product Safety

Napstar products must only be utilized for their designated child hygiene operations. Parents, childcare employees, and guardians must maintain consistent active child supervision when items are being worn or handled. Immediately discard outer wrappers, binding bands, and packaging materials to prevent accidental choking hazards.

5.2 Sensitivity & Allergic Irritation

While formulation layers are thoroughly developed to be gentle, skin profiles vary. In the rare event of localized skin irritation, immediately discontinue nappy use and seek professional medical guidance.

6. SMS & Email Marketing Consent

By opting in at checkout, customers consent to receiving transactional alerts, shipping reminders, and brand marketing updates via email or SMS. You may opt out instantly at any point by selecting the "unsubscribe" footer block, replying STOP to SMS dispatches, or reaching out directly to support channels. All communication structures comply with the Spam Act 2003 (Cth).

7. Wholesale & Commercial Supply Terms

Commercial wholesale client accounts (such as registered Childcare Centres, schools, and care facilitators) are governed under strict billing and supply terms. Payments must clear within agreed transactional cycles. Retention of title on delivered goods remains exclusively with Napstar until all relevant invoices are settled in full. Late payments may result in immediate supply pipeline suspension.

8. Subscription & Recurring Supply Terms

8.1 Billing Cycles

By registering for a Napstar Subscription, customers authorize recurring automatic payment processes on their designated cards aligned to their selected delivery interval schedules.

8.2 Cancellation Policy

Subscribers can modify, adjust, or cancel active subscription tracks at any time via the customer billing portal. To prevent unexpected automated shipping runs, cancellations must complete at least 24 hours prior to the next scheduled payment date.
